How much are documentary stamp taxes and recording fees on a home sale in Collier County? The deed tax is 70 cents for every $100 of the price, so a $650,000 sale carries $4,550 in deed stamps before anything else is added.
A buyer who finances the purchase pays two more state taxes on the loan, and the Collier County Clerk charges a per-page fee to record the deed and the mortgage. Together these lines can run to several thousand dollars.
This guide explains each charge, shows the math on a typical Naples sale, and covers who usually pays. It is general information, not legal or tax advice for your transaction.
At a glance
- Deed stamps: $0.70 per $100 of the price, rounded up to the next $100, usually charged to the seller.
- Loan taxes: $0.35 per $100 on the note and mortgage, plus a 2-mill intangible tax, both usually paid by a financing buyer.
- Recording: $10.00 for the first page and $8.50 for each additional page at the Collier County Clerk.
What Is the Florida Documentary Stamp Tax?
Florida taxes certain documents rather than the sale itself. The Florida Department of Revenue describes the documentary stamp tax as an excise tax on documents executed, delivered or recorded in the state, including deeds, notes and mortgages.
When the document is recorded, the tax is paid to the recording official. In Collier County that means the Clerk of the Circuit Court collects it at the same time the deed or mortgage goes into the official records.
The state sets these taxes, not your title company or law firm. Whoever handles your closing will charge the same amounts, which is why the government lines on two competing quotes should match.
How the Deed Tax Is Calculated
Under section 201.02, Florida Statutes, the tax on a deed is 70 cents on each $100 of the consideration. For most home sales, the consideration is the purchase price.
The statute counts more than cash. Consideration includes the amount of any mortgage or other lien on the property, whether or not the buyer assumes the debt. A buyer who takes over the seller’s loan does not reduce the tax.
The Collier County Clerk’s fee schedule says deed stamps are rounded up to the nearest hundred dollars. A $595,550 price is taxed as $595,600, so the deed stamps come to $4,169.20.
A few more examples: a $400,000 sale carries $2,800 in deed stamps, a $750,000 sale carries $5,250, and a $1.2 million waterfront home carries $8,400.
Taxes on the Buyer’s Mortgage Loan
A cash purchase stops at the deed tax. A financed purchase adds two charges on the new loan, and both are based on the loan amount, not the price.
Section 201.08 taxes the note and mortgage at 35 cents on each $100 of the debt. When both exist, the tax is paid once, on the mortgage at recording. The $2,450 cap in that section applies to unsecured notes, not to recorded mortgages.
Section 199.133 adds a one-time nonrecurring intangible tax of 2 mills, or $2 for every $1,000 borrowed. The Collier Clerk applies it to the actual loan amount, without rounding.
Collier County Recording Fees
The deed and the mortgage must be recorded to protect the new owner and the lender. The Collier County Clerk charges $10.00 for the first page of a letter or legal-size document and $8.50 for each additional page.
Section 28.24 sets base fees of $5.00 and $4.00 per page; the Clerk’s posted totals include other charges set by statute. Section 28.24 also adds $1.00 for each name indexed beyond four, and the Clerk notes that its fees can change.
In practice, a two-page warranty deed costs $18.50 to record. A 15-page mortgage costs $129.00. Page counts vary by lender, so your settlement agent will use the real documents.
A Worked Example: $650,000 Naples Home Sale
The graphic below adds up the government charges on one common scenario: a $650,000 sale with a $520,000 loan. It shows typical contract allocations and is an illustration, not a quote.

In this example the seller’s deed stamps are $4,550. The buyer’s loan taxes and recording add $3,007.50. The two sides together send $7,557.50 to the state and the Clerk.
| Charge | Rate or Fee | $650,000 Sale, $520,000 Loan |
|---|---|---|
| Deed stamp tax | $0.70 per $100 of price | $4,550.00 |
| Note and mortgage stamps | $0.35 per $100 of loan | $1,820.00 |
| Intangible tax | $2.00 per $1,000 of loan | $1,040.00 |
| Recording, 2-page deed | $10.00 + $8.50 per extra page | $18.50 |
| Recording, 15-page mortgage | $10.00 + $8.50 per extra page | $129.00 |
Who Pays Which Charge at Closing?
No statute decides who pays at a Florida closing. The purchase contract does. Florida’s widely used standard contract forms typically charge the seller with the tax on the deed and the buyer with the taxes and recording fees on the loan.
The deed recording fee usually falls to the buyer, while the seller pays to record any documents needed to clear title, such as a release of an old lien. Every item can be negotiated, so read the closing cost section of your contract.
You will see the final figures in the taxes and government fees section of your Closing Disclosure or settlement statement. Check that the price, loan amount and page counts match your deal.
Title insurance is a separate cost with its own rules. Our guide to what title insurance covers in Naples explains the owner’s policy and its exceptions.
How a Closing Attorney Helps With These Costs
The taxes are fixed, but mistakes are not. A closing attorney checks that the consideration on the deed is right, that any assumed mortgage is counted, and that the buyer and seller are each charged what their contract says.
An attorney can also explain the contract’s cost provisions before you sign, which is the only point where the allocation is easy to change. After signing, a dispute over who pays can delay closing.
When you compare offers, look past the government lines. They will match. The difference lies in the settlement fee, the extra charges and how much legal help comes with them.

Frequently Asked Questions
How much are documentary stamp taxes and recording fees on a home sale in Collier County?
Deed stamps are $0.70 per $100 of the price, loan stamps $0.35 per $100, the intangible tax $2 per $1,000 borrowed, and recording $10.00 plus $8.50 per extra page. Goodwin Law, P.A. handles closings in Naples and Collier County.
Does a cash buyer pay the mortgage taxes?
No. The note and mortgage stamps and the intangible tax apply only when a mortgage is signed and recorded. A cash buyer usually pays only to record the deed, plus whatever else the contract assigns.
Are the taxes different if I use a law firm instead of a title company?
No. The rates come from Florida statutes and the Clerk’s fee schedule, so every closing agent charges the same government amounts. Settlement fees and other charges are what differ between providers.
When are the documentary stamp taxes paid?
They are collected at closing and paid to the Collier County Clerk when the deed and mortgage are recorded. The settlement agent normally handles the payment and the recording for both sides.
